With the decision of the Public Procurement Board dated 13.11.2018 and numbered 2018/DK.D-357, it was unanimously decided that “Foreign real persons and legal entities may register to EKAP by using a foreign identity number or potential tax identity number and by authenticating their identity, and that such persons/entities may register to EKAP by submitting the documents specified in Article 7 of the Electronic Tender Implementation Regulation in accordance with the regulations of the tender implementation regulations regarding the manner of submission of documents”.

According to the said Article 7, which regulates the registration of real persons and legal entities participating in tenders to EKAP, it is stated that a protocol will be issued between the Authority and real and legal entities as a result of the registration process of real persons and legal entities participating in tenders to EKAP. Also, the protocol will specify at most two responsible persons who will carry out the works and transactions in EKAP on behalf of the real person or legal entity. The platform responsible will be able to identify, register and authorise other users who can perform transactions on behalf of the real person or legal entities through EKAP by creating their password using the activation link sent to them by the Authority and logging in with their username and password.

And so:
Foreign real persons and legal entities will be able to register to EKAP by authenticating their identity by using their foreign identification number or potential tax identification number.
These persons/entities shall submit the documents specified in Article 7 of the Implementing Regulation on Electronic Tender Implementation in accordance with the regulations of the procurement implementing regulations on the manner of submission of the documents and their equivalents issued in accordance with the legislation in their own country registration to EKAP can be carried out by submitting their submissions.
Since the documents required for registration are many and varied and the legislation is complicated, it would be better if these applications are made on behalf of the aforementioned persons and organisations by professionals who are experts in their fields.
